Part A – Legal Requirements

You are tasked to set up a business/organisation within the Sport and Recreation or fitness industry; you have to give a brief explanation of the outline of the company first and then research the legal requirements for setting up your business and apply these to your business of choice.

The business idea could be a local gym, local AFL coaching, Soccer Academy and so on.

What information does your company need to access, for example Laws and legal information are managed by many different departments of government. Some legal requirements, for example, professional registration, may be administered by industry bodies, if so explain who they are and how they impact on your company.

Remember to use the local, state and national governing bodies for help in terms of sport specific requirements.

As the manager of your organisation you will need to know the difference between various contract types and also when you would use them (if applicable) for your business. Please complete the table below.

Part C – Legal Compliance

As the manager it is your responsibility to review all the policies and procedures to ensure the organisation is compliant and assess if there is a better way of completing daily tasks.

Pick TWO of the following examples of not-compliant and complete the table below.

  • Privacy Law. You found out that when you logged into the company computer to view the next weeks’ schedule, all your staff had access to all personal detail files of all staff members and contractors and also clients/players.
  • Equipment storage room is a mess, with everything dumped on the floor
  • Recently a staff member was hit in the face by a falling object in the equipment store room – nothing was done about it. No injury report or WHS follow up.
  • You found out that some staff members did not update their First Aid course.
  • You have realised that your Induction/Orientation procedure is not up-to-date after the changes you implemented during the last management meeting.
